Disclosure request from agencies
Guidance for staff for requests from external organisations
If a external agency requests disclosure of personal information, then we will only consider disclosure requests from the Police, DWP etc with their appropriate valid form, authorised by a senior officer.
If you are a member of staff and are asked about a disclosure request, firstly identify what type of disclosure request it is. Requests from external agencies must always be sent to WCC using secure email or by post.
For offences against a child under 18
Police requests for information which involve a child under the age of 18 are dealt with under ‘the 2013 Protocol and Good Practice Model Disclosure of information in cases of alleged child abuse and linked criminal and care directions hearings.’ (This is most commonly referred to as an Annex C request).
If it is an Annex C request then the agency needs to contact the Mash Team direct on 01926 414144 or email email@example.com
For offences against a child who is now aged 18 or over
Information Management will process all requests from the police where the police are investigating an offence that relates to a historical crime (at the time of the alleged offence – the victim was aged under 18.) The victim will now be an adult. These requests are logged by Information Management centrally. The legal gateway that allows us to share information is ‘The Data Protection Act 1998 S29(3) prevention/detection of crime-apprehension/prosecution of offenders.’
For these and any other disclosure request, including S29/DPA requests please contact the Information Management Team on 01926 418633. Government agencies must email us, using our secure email – firstname.lastname@example.org.
The IM team will inform relevant Service Manager if S29 investigation is concerning their area to see if operational input is required.
Any offence involving an adult
Police requests for information on an adult are coordinated by the Information Management Team but will be passed to the relevant team in WCC. These requests are logged by Information Management centrally. The legal gateway that allows us to share information is ‘The Data Protection Act 1998 S29(3) prevention/detection of crime-apprehension/prosecution of offenders.’ Government agencies must email us, using our secure email – email@example.com.
Any other disclosure request
Disclosure requests involving access to any historic/archive records must be notified to Information Management even if the team are processing locally. Please contact the Information Management Team for advice and guidance.
Information Sharing between Local Authorities Childrens/Adults Teams
Please note that if a request to share information is made by a professional at another Local Authority, this should be dealt with by the relevant social care team as business as usual. Please contact the Information Management Team if advice is required.
